An emergency arbitrator is an effective protection mechanism in line with the requirements of commercial life, providing parties with the temporary legal protection they need in emergency situations in which the arbitrator or arbitrators are not expected to begin their assignment.
The JIACA Emergency Arbitrator Rules apply to applications by a party that urgently needs temporary legal protections for the appointment of an emergency arbitrator, before the file is referred to the sole arbitrator or arbitration council.
The party applying for the emergency arbitrator is not required to have filed a request for arbitration, petition, or response to the request for arbitration or motion to respond. After the request is received by the Secretariat of the Justice Agency for International Arbitration, the emergency arbitrator is appointed within 2 working days and the emergency arbitrator makes his decision within 7 days.
The emergency arbitrator’s decision is binding on the parties. The parties must implement the emergency arbitrator’s decision without delay.
